Health & Safety Policies and Programs

You are considered a high risk by the MOL and WSIB, like any insurance underwriter, those who make claims will pay. If you have a health and safety program in place, you may avoid costly MOL charges and WSIB penalties. The MOL and WSIB are working on a special program whereby companies with LTI's are targeted for audits, are you prepared? If not it could mean costly fines and or penalties/surcharges under the Occupational Health and Safety Act and the Workplace Safety & Insurance Act.

Under the Occupational Health and Safety Act, employers are required to ‘Prepare and review at least annually a written occupational health and safety policy and develop and maintain a program to implement that policy.’  (Act, Sec 25.2.J)

So, not only must each employer who employs more than 5 employees prepare a health and safety policy, which is the company statement. Usually this statement is less than one page in length, however the program to implement the statement is much more comprehensive, this is where we would outline items such as:

There is a false belief that if a contractor does not have more than 5 payroll employees, but does sub contract to more than 5 workers, they do not require a health and safety policy. This is not true; all employers who employ more than 5 employees on a regular basis, whether or not payroll or sub contract basis must have a written health and safety policy and program.
